Hereinafter referred to as the \"Seller\" or the \"Company\", on the one hand, and the natural or legal person purchasing the company's products or services, hereinafter referred to as the \"Buyer\", or the \"Customer\", on the other hand, it has been stated and agreed as follows :<\/p>\n

\nThese General Terms and Conditions of Sale determine the rights and obligations of the parties in connection with the online sale of Products offered by the Seller.<\/p>\n

Article 2: General Provisions<\/strong>

The Customer declares that he has read all these General Terms and Conditions of Sale, and where applicable the Special Terms and Conditions of Sale relating to a product or service, and accepts them without restriction or reservation.<\/p>\n

The Client acknowledges that he has received the necessary advice and information to ensure that the offer meets his needs. The Client declares that he is in a position to enter into a legal contract under French law or to validly represent the natural or legal person for whom he undertakes to do so. Unless proven otherwise, the information recorded by the Company constitutes proof of all transaction.<\/p>\n

Article 3: Prices<\/strong>
\nLes prix des produits vendus au travers du site Internet sont indiqu\u00e9s en Euros toutes taxes comprises (TVA + autres taxes \u00e9ventuelles) sur la page de commande des produits, et hors frais d’exp\u00e9dition. Des droits de douane ou autres taxes locales ou droits d’importation ou taxes d’\u00e9tat sont susceptibles d’\u00eatre exigibles dans certains cas. Ces droits et sommes ne rel\u00e8vent pas du ressort du Vendeur. Ils seront \u00e0 la charge de l’acheteur et rel\u00e8vent de sa responsabilit\u00e9 (d\u00e9clarations, paiement aux autorit\u00e9s comp\u00e9tentes, etc.). Article 4: Conclusion of the online contract<\/strong>
\nThe Customer must follow a series of steps specific to each Product offered by the Seller in order to complete his order. However, the steps described below are systematic :
\n\u27a2 Information on the essential characteristics of the Product ;
\n\u27a2 Choice of the Product, if necessary of its options and indication of the Customer's essential data (identification, address...) ;
\n\u27a2 Acceptance of these General Terms and Conditions of Sale ;
\n\u27a2 Checking of the order elements and, if necessary, correction of errors ;
\n\u27a2 Follow-up of payment instructions, and payment of products ;
\n\u27a2 Product delivery.
\nThe Customer will then receive confirmation by email of payment for the order, as well as an acknowledgement of receipt of the order confirming it. He will receive a.pdf copy of these general terms and conditions of sale. For the products delivered, this delivery will be made to the address indicated by the Customer. For the purpose of the proper execution of the order, and in accordance with Article 1316-1 of the French Civil Code, the Client undertakes to provide its true identification details. The Seller reserves the right to refuse the order, for example for any abnormal request, made in bad faith or for any legitimate reason.<\/p>\n

Article 5: Products and Services<\/strong>
\nThe essential characteristics of the goods, services and their respective prices are made available to the buyer on the company's websites. The customer certifies that he has received a detailed description of the delivery costs as well as the terms of payment, delivery and performance of the contract. The Seller undertakes to honour the Customer's order within the limits of available Product stocks only. Failing this, the Seller shall inform the Customer. This contractual information is presented in detail and in French. In accordance with French law, they are summarized and confirmed when the order is validated. The parties agree that illustrations or photos of products offered for sale have no contractual value. The period of validity of the Products' offer and their prices are specified on the Company's website. Unless otherwise specified, the rights granted hereunder are granted only to the natural person who signed the order (or the person who holds the e-mail address provided). In accordance with the legal provisions concerning conformity and hidden defects, the Seller shall refund or exchange defective products or products that do not correspond to the order.

The Customer must carefully fill in all fields of the delivery form at the time of ordering, including his delivery details, while indicating a fixed or mobile phone number. Neither DEOBINDER nor the Supplier can be held responsible for any inability to deliver due to inaccuracy or error in the delivery address.
\nDelivery times in Metropolitan France at the time of validation of the order are 7 to 10 working days from the end of the sale indicated on the website.<\/p>\n

In the event of impossibility of delivery on the day of the Appointment due to inappropriate information, difficulties of access or passage not previously reported by the Customer or the Customer's absence from the Appointment in violation of the commitments made during the contact, new delivery charges may be invoiced by D\u00c9SOB\u00c9ISSANT-ES, which will contact the Customer for payment of these new delivery charges before any re-delivery of the Product. In the event of non-payment of these fees, D\u00c9SOB\u00c9ISSANT-ES reserves the right not to deliver the Product. The risk of damage resulting from these constraints will also be borne by the Customer.<\/p>\n

Except in the event of lack of conformity or hidden defects, no further claims and\/or reservations will be accepted by D\u00c9SOB\u00c9ISSANT-ES, after receipt of the Products by the Customer, (excluding the right of withdrawal).<\/p>\n

Article 8: Availability and presentation<\/strong>
\nOrders will be processed within the limits of our available stocks.<\/p>\n

Article 9: Payment<\/strong>
\nPayment is due immediately upon order, including for pre-order products. The Customer can pay by credit card via PayPal without having an account. Cards issued by banks domiciled outside France must be international bank cards (Mastercard or Visa). The secure online payment by credit card is made by our payment provider. The information transmitted is encrypted according to the rules of the art and cannot be read during transport on the network. Once the payment has been initiated by the Customer, the transaction is immediately debited after verification of the information. In accordance with Article L. 132-2 of the French Monetary and Financial Code, the payment undertaking given by card is irrevocable. By providing his bank details at the time of sale, the Customer authorises the Seller to charge his card for the amount relating to the price indicated. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or if it is impossible to charge the card, the Sale is immediately cancelled by operation of law and the order cancelled.<\/p>\n

Article 10: Withdrawal period<\/strong>
\nIn accordance with Article L. 121-20 of the Consumer Code, \"the consumer has a period of fourteen clear days to exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception, where applicable, of return costs\". \"The period referred to in the preceding paragraph shall run from the date of receipt for the goods or acceptance of the offer for the provision of services\".<\/p>\n

The right of withdrawal can be exercised by contacting the Company as follows: backtothefuture@yestoday.fr<\/p>\n

En cas d\u2019exercice du droit de r\u00e9tractation dans le d\u00e9lai susmentionn\u00e9, seul le prix du ou des produits achet\u00e9s et les frais d\u2019envoi seront rembours\u00e9s, les frais de retour restent \u00e0 la charge du Client. Les retours des produits sont \u00e0 effectuer dans leur \u00e9tat d’origine et complets (emballage, accessoires…) de sorte qu’ils puissent \u00eatre recommercialis\u00e9s \u00e0 l\u2019\u00e9tat neuf ; ils doivent si possible \u00eatre accompagn\u00e9s d\u2019une copie du justificatif d’achat.<\/p>\n

Article 11: Guarantees<\/strong>
\nConform\u00e9ment \u00e0 la loi, le Vendeur assume deux garanties : de conformit\u00e9 et relative aux vices cach\u00e9s des produits. Le Vendeur rembourse l’Acheteur ou \u00e9change les produits apparemment d\u00e9fectueux ou ne correspondant pas \u00e0 la commande effectu\u00e9e. La demande de remboursement doit s’effectuer de la mani\u00e8re suivante : backhome@yestoday.fr .<\/p>\n

Le Vendeur rappelle que le Consommateur : – dispose d’un d\u00e9lai de 2 ans \u00e0 compter de la d\u00e9livrance du bien pour agir aupr\u00e8s du Vendeur – qu’il peut choisir entre le remplacement et la r\u00e9paration du bien sous r\u00e9serve des conditions pr\u00e9vues par l’art. 4, apparemment d\u00e9fectueux ou ne correspondant pas – qu’il est dispens\u00e9 d’apporter la preuve l\u2019existence du d\u00e9faut de conformit\u00e9 du bien durant les 6 mois suivant la d\u00e9livrance du bien. – que, sauf biens d\u2019occasion, ce d\u00e9lai sera port\u00e9 \u00e0 24 mois \u00e0 compter du 18 mars 2016 – que le Consommateur peut \u00e9galement faire valoir la garantie contre les vices cach\u00e9s de la chose vendue au sens de l\u2019Article 1641 du Code civil et, dans cette hypoth\u00e8se, il peut choisir entre la r\u00e9solution de la vente ou une r\u00e9duction du prix de vente (dispositions des articles 1644 du Code civil).<\/p>\n

Article 13: Intellectual Property Rights<\/strong>
\nTrademarks, domain names, products, software, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the Seller. No transfer of intellectual property rights is made through these GTC. Any total or partial reproduction, modification or use of these properties for any reason whatsoever is strictly prohibited.<\/p>\n

Article 14: Force majeure<\/strong>
\nThe performance of the Seller's obligations hereunder shall be suspended in the event of the occurrence of a fortuitous event or force majeure that would prevent its performance. The Seller shall notify the Customer of the occurrence of such an event as soon as possible.<\/p>\n

Article 15: Invalidity and amendment of the contract
\nIf one of the provisions of this contract is cancelled, this cancellation will not result in the cancellation of the other provisions that will remain in force between the parties. Any contractual amendment is only valid after a written agreement signed by the parties.<\/p>\n
